The nature of the arbitral award cannot be extended to votes cast on the basis of error, bribery or violation of the fundamental rights of the parties. On this basis, and in order to prevent cases such as possible abuses of the parties, arbitrators exceeding the limits of authority, etc., objections to arbitral awards have been considered and supported both in national regulations and in important international documents. However, support for the arbitration process requires that the grounds for objecting to the vote and its violations be kept to a minimum, and that their diversity will always be in the hands of the convict so that he can easily shrug off the vote, and this It is in conflict with the purpose and philosophy of arbitration. In Iran, the most important law on arbitration is the Commercial Arbitration Law of Iran, passed in 1997, which is inspired by the UNCITRAL Model Law of the United Nations Economic Commission for 1985, and although its adoption is a step forward, this law is still in the field. There are some shortcomings such as determining the nationality of the arbitrator, the scope of application of the law, the directions of annulment of the verdict, and the effects of objecting to the arbitrator on its executive process. In all legal systems, court oversight of the arbitral award is recognized, and the award can be challenged in the court of the country most closely associated with the case; Violations of arbitral awards are similar to national regulations and international instruments, and almost identical.  }, keywords = {Keywords: invalidity,international arbitrations,objection,annulment,place of arbitration}, title_fa = {طرق اعتراض به آرای داوری داخلی و تجاری بین المللی}, abstract_fa = {داوری بعنوان یکی از بهترین و کارآمدترین روشهای حلوفصل مسالمتآمیز اختلافات بویژه در زمینهی روابط تجاری، مورد توجه دولتها، حقوقدانان و بازرگانان قرار گرفته است. ویژگی الزامآوربودن رای داور را نمیتوان به آرائی که بر مبنای اشتباه، رشوه یا نقض حقوق اساسی طرفین صادر شدهاند، سرایت داد. بر همین مبنا و بمنظور جلوگیری از مواردی چون، سوءاستفادههای احتمالی طرفین، تجاوز داوران از حدود اختیارات و ...، اعتراض به آراء داوری چه در مقررات ملی و چه در اسناد مهم بینالمللی مورد توجه و حمایت قرار گرفته است. با این حال حمایت از جریان داوری ایجاب می نماید، جهات اعتراض به رای و موارد نقض آن تا حد امکان، حداقلی باشد، والا تنوع آنها همواره دستاویزی خواهد بود در دست محکومعلیه تا بتواند به راحتی از اجرای رای شانه خالی کند و این با هدف و فلسفهی وجوبی داوری در تضاد و تعارض است. در ایران مهمترین قانون موجود در باب داوری، قانون داوری تجاری ایران مصوب 1376 بوده که ملهم از قانون نمونه آنسیترال 1985 کمیسیون اقتصادی سازمان ملل متحد میباشد و گرچه تصویب آن حرکتی روبه جلو به حساب میآید ولی این قانون هنوز در زمینههایی چون تعیین تابعیت رای داور، محدودهی اعمال قانون، جهات ابطال رای، آثار اعتراض به رای داور بر روند اجرائی آن دارای کاستیهایی است.      در تمامی نظامهای حقوقی نظارت محاکم بر رای رای داوری برسمیت شناخته شده، و رای در دادگاه کشوری قابل اعتراض است که نزدیکترین ارتباط را با دعوی داراست؛ موارد نقض آراء داوری در مقررات ملی و اسناد بینالمللی مشابه، و تقریبا یکسان میباشد.      }, keywords_fa = {بطلان,داوری های بینالمللی,اعتراض,ابطال,محل داوری}, url = {https://www.jaml.ir/article_241975.html}, eprint = {https://www.jaml.ir/article_241975_456ea3dcf291a3207ea7e9ef26c4e727.pdf} }
