According to the rules of the Qur'an and Sunnah (Hadith Rifa ') and reason, in Islamic jurisprudence, urgency is an obstacle to criminal responsibility and is very important in relation to crimes against individuals. But there has been little discussion about assaults on lives, especially murders. Since there is a brief overview of the urgency of murder in the Iranian penal code, and in relation to the issue with the provision of Article 167 of the Constitution, we refer to fatwas and valid jurisprudential sources, so we have to study the jurisprudence of the issue, although the issue in jurisprudence Only in the context of jurisprudential issues, jurists have been discussed and scrutinized in a scattered manner, and most of the discussions are that urgency is not a license for intentional killing, and the reason for this is the existence of the jurisprudential rule of indifference in the field. However, there is an exception to this rule, each of which requires general conditions. یکی از قواعد فقهی که هم در امور مدنی و هم در امور کیفری کاربرد فراوانی دارد، قاعده اضطرار می‌‌باشد، به طوری که اعمال این قاعده موجب انطباق احکام شرعی با اوضاع و احوال شده و مسیر اجرای عدالت هموار می‌‌گردد. به موجب احکام قرآن و سنت (حدیث رفع) و عقل، در فقه اسلام اضطرار مانعی برای مسئولیت کیفری است و در رابطه با جرایم بر علیه با اشخاص دارای اهمیت زیادی می‌‌باشد. اما در مورد تعرضات نسبت به جان بویژه قتل این قاعده محل بحث اندکی بوده است. از آنجایی که در رابطه با اضطرار در قتل قوانین جزایی ایران دارای اجمال می‌‌باشد و در رابطه با موضوع با حکم اصل ۱۶۷ قانون اساسی به فتاوی و منابع معتبر فقهی مراجعه می‌‌شود، لذا ناگزیر از مطالعه فقهی موضوع می‌‌باشیم، هر چند که موضوع در فقه نیز صرفا در لابلای مباحث فقهی فقها به صورت پراکنده مورد بحث و تدقیق قرار گرفته است و غالب مباحث هم این است که اضطرار مجوزی برای قتل عمدی نمی‌‌باشد و دلیل این امر نیز وجود قاعده فقهی لا‌تقیه فی الدماء می‌‌باشد. اما با این وجود نیز استثنایی بر این حکم وارد شده است که هر کدام نیازمند شرایط عمومی‌‌می‌‌باشد.<br />  https://www.jaml.ir/article_244689_867da1e3407fc958ab1cc8d716d6d9e0.pdf
