The truth of repentance is man's return to God, and it is a reaction on the part of man to his unworthy behavior, who has spent his life in divine sin. Recently, in the criminal law of Iran, based on the jurisprudential sources of the institution of repentance to prevent the recurrence of crime and correction of criminals has been legislated and in the eleventh chapter of the second part of the Islamic Penal Code adopted in 1992 has been addressed.In this article, the concept of the importance and effects of the role of repentance in the fall of the hadd punishment from the perspective of jurisprudence and law, as well as the views and opinions of famous jurists are discussed. It is hoped that it will be noticed and studied by esteemed students and other interested parties. مسئله توبه، یکی از آموزه های تربیتی واخلاقی ومهم قران کریم و روایات اسلامی است ودر شرع مقدس اسلام از جایگاه ومنزلت ویژه ای برخوردار است . <br />حقیقت توبه ،بازگشت انسان به سوی خداست، وواکنشی است از سوی انسان به رفتارناشایست خویش که عمر خود را در معصیت الهی صرف نموده است.انجام این عمل ،اختیاری وارادی است واز نظر شرع وعقل ،واجب وضروری است وتاخیرش جائز نیست .<br />اخیراً در حقوق کیفری ایران، نیز به تاسی از منابع فقهی نهاد توبه برای جلوگیری از تکرارجرم واصلاح مجرمین قانون گذاری شده ودر فصل یازدهم بخش دوم قانون مجازات اسلامی مصوب 92 به آن پرداخته شده است .<br />در این مقاله به مفهوم واهمیت وآثارونقش توبه درسقوط مجازات حد از منظر فقه وقانون ونیزبه نظرات ودیدگاه های فقهای مشهور پرداخته شده است. امید است که مورد توجه ومطالعه دانشجویان محترم وسایر علاقمندان قرار گیرد .واژگان کلیدی :توبه ،حد ،تعزیر،منصوصات شرعی ،حق الله و حق الناس ،معاذیز قضایی وقانونی.
