انجمن علمی فقه و حقوق خانواده ایران فصلنامه علمی فقه و حقوق نوین 2717-1469 7 22 2025 04 21 Analytical examination of the jurisprudential foundations of defensive jihad with an emphasis on the method of al-Qur'an jurisprudence بررسی تحلیلی مبانی فقهی جهاد دفاعی با تاکید بر روش فقه القرآن 1 17 724370 10.22034/jml.2025.2048035.1414 FA عبدالکریم قاسمی راد استادیار و عضو هیات علمی گروه معارف اسلامی دانشگاه شهید چمران اهواز Journal Article 2024 12 13 Fariqin jurists often divide Jihad into defensive and initial Jihad and consider the cause of initial Jihad to be their disbelief and bringing them into Islam.But when referring to the verses of the Holy Quran without mental background from the words of the jurists, it is concluded that the mention of this reason for Jihad does not have any Quranic support, but rather all the verses of Jihad and fighting in the Holy Quran, according to their context and apparent meaning, are related to They are defensive Jihad, and it seems that there is a verse in the Qur'an that indicates the initial Jihad to forcibly bring infidels into Islam; does not existTherefore, it seems that the division of Jihad into primary and defensive is basically incorrect and Jihad in Islam will only be defensive with the explanation that it is suggested that Jihad in Islam be divided into defensive in a particular sense and defensive in a general sense. فقهای فریقین غالبا جهاد را به دو قسم دفاعی و ابتدائی تقسیم نموده و علت جهاد ابتدائی را نیز کفر ایشان و وارد نمودن آنها در اسلام می دانند، که البته این حکم یکی از اسباب بروز شبهه اجبار غیر مسلمانان به پذیرش اسلام گشته است.اما وقتی بدون پیشینه ذهنی از کلام فقهاء، به آیات قرآن کریم مراجعه شود چنین استنباط می شود که ذکر این سبب برای جهاد پشتوانه قرآنی نداشته و بلکه تمام آیات جهاد و قتال در قرآن کریم با توجه به سیاق و معنای ظاهری آنها، در رابطه با جهاد دفاعی می باشند و به نظر می رسد در قرآن آیه ای که دال بر جهاد ابتدائی برای وارد نمودن اجباری کفار در اسلام باشد؛ وجود ندارد. لذا به نظر می رسد اساساً تقسیم جهاد به ابتدائی و دفاعی نادرست بوده و جهاد در اسلام فقط دفاعی خواهد بود با این توضیح که پیشنهاد می شود جهاد در اسلام به دفاعی بالمعنی الاخص و دفاعی بالمعنی الاعم تقسیم گردد. https://www.jaml.ir/article_724370_05d6e58867f8f11d897fe52a32972a14.pdf
