Abstract
The use of "Electronic Monitoring System" which has been focused on the advancement and development of modern science and technology, was considered as a means of monitoring and protection of those sentenced to imprisonment. The purpose of the application and implementation of the electronic monitoring system is to help reduce the density of the incarcerated population and ultimately control criminal inflation. The existence of this system, as a guarantee of implementation, reduces the costs and avoids the distance of those sentenced to imprisonment from the society and protects their relationship in the social system and even prevents the situation from causing problems in their families. Having said that, for the first time in Iran's criminal law system, in Article 62 of the Islamic Penal Code, monitoring of those sentenced to penal servitude through electronic systems was established. This is despite the fact that in the Criminal Procedure Law, the legislator has established regulations regarding this type of supervision according to paragraph "C" of Article 217 and Articles 553 to 558.
