Copyright is one of the most common types of literary and artistic property rights that are recognized in international conventions and domestic legal documents. Violation of this right is considered scientific and literary theft. In the domestic legal system, this right has been guaranteed in the Law on Protection of the Rights of Authors, Authors until today in the Law on Combating Scientific Frauds, the Draft Comprehensive Bill of Intellectual Property Rights and the Draft Protection of Private Data in Cyberspace. In international conventions, the oldest document in this field is the Bern Convention, which has been revised several times. Besides that, the TRIPS Agreement of the World Trade Organization, the Nice Agreement has rules guaranteeing the protection of copyright and combating scientific plagiarism.
A significant difference between the system of international conventions and Iran's legal system in the field of copyright protection and combating plagiarism can be seen: firstly, the principle of national behavior and the principle of absolute sovereignty in Iran's legal system are not respected in relation to copyright and there is a kind of discriminatory view. It has been created among the creators of Iranian and foreign scientific, literary and artistic works, while one of the emphasis of the Berne Convention as the main international convention related to this matter. Secondly, the differential procedure in the field of copyright violations is not observed in Iran's legal system despite the emphasis of international conventions.
