With the expansion of the digital space and technological developments in the field of information production and transmission, traditional concepts of intellectual property have faced new challenges. Literary and artistic works, software, databases and other intellectual products can now be easily copied, republished and manipulated, without the creator of the work being able to effectively protect his rights. In the meantime, the Iranian legal system, like many countries, is faced with the need to review laws, strengthen enforcement guarantees and formulate regulations appropriate to the digital ecosystem. This article analyzes the challenges in the digital space by examining the foundations of intellectual property rights in Iran. One of the most important issues is the lack of clear regulations on digital works, the lack of technical mechanisms to protect the rights of the creator, and the weakness in the effective enforcement of intellectual property rights in the online context. This study, while examining the experience of other countries, suggests solutions such as strengthening electronic registration of works, developing special laws for the digital space, and cooperation between legal, technical, and judicial institutions to improve the level of legal protection in Iran. The conclusion of the article emphasizes the necessity of adapting domestic laws to global developments and creating a balance between free access to information and the exclusive rights of the author.
