In recent years, the development of communication technologies and the expansion of the Internet have provided the grounds for various forms of intellectual property rights infringement in cyberspace. In such circumstances, the fundamental question is what specific and reliable legal mechanisms the Iranian legal system provides to combat these infringements. The present article, adopting an analytical–descriptive approach and based on library research, examines the substantive, procedural, and techno-legal mechanisms for addressing intellectual property infringements on the Internet within the Iranian legal system. To this end, the study first explains the principles and foundations governing the protection of intellectual property in cyberspace, as well as the scope of protection for literary, artistic, and industrial rights in the digital environment. It then analyzes the role of domestic laws, including the Law on Protection of Authors’, Composers’ and Artists’ Rights, the Law on Registration of Patents, Industrial Designs and Trademarks, and the Electronic Commerce Law, in establishing frameworks for combating online infringement. Furthermore, the civil liability of infringers, the legal status of intermediaries and electronic communication service providers, and the role of technical mechanisms such as digital signatures and technological protection measures are evaluated along with the extent of legal support afforded to them. The findings of the research indicate that despite the existence of scattered regulations within Iranian law, there are still significant gaps in establishing a comprehensive framework for combating intellectual property infringements in cyberspace. Therefore, strengthening both the legislative and enforcement frameworks in this field is considered essential.
