Abstract
Nowadays, with the effectiveness of clinical criminology standards, a new model for juvenile delinquency has emerged, which is called differential criminal proceedings. Among all the issues related to discriminatory criminal proceedings for children and adolescents, the requirements and guarantees governing this new model of criminal justice are important. One of the mechanisms whose implementation is one of the most important manifestations of paying attention to these requirements and guarantees is the alternative of imprisonment, which is mainly to avoid the adverse effects of the prison environment on children and adolescents and instead use regulatory and correctional mechanisms. And treatment and rehabilitation have been emphasized for this vulnerable and deserving group. In this article, we discuss the status, functions and effects of differential litigation in the criminal law of children and adolescents. The main question has been what is the status and necessity of differential proceedings in the field of criminal rights of children and adolescents and what are its manifestations? In response, it has been concluded that discriminatory proceedings are one of the most important foundations of modern criminal law in relation to crimes committed by children and adolescents, which, under the influence of criminological ideas and teachings, try to determine and implement the most effective and efficient answers.
