Paraphilia is the same as sexual deviation. People with this type of disorder have a strong desire to perform abnormal sexual behaviors that are contrary to religious teachings. Given this problem, the question is what will happen to these people in terms of sexual prohibitions, including the implementation of hudud and ta’zir. Is it possible to suspend the implementation of hudud and ta’zir on a person due to paraphilia?

This study seeks to examine the Shariah permissibility of implementing hudud and ta’zir for people with paraphilia. For this purpose, a descriptive-analytical method has been used.

Based on the findings and results, it was stated that if paraphilic people commit forbidden sexual behavior, they will be subject to ta’zir punishment. Regarding haddi punishment, it was also stated that among paraphilic behaviors, only sexual intercourse with a child in pedophilia and sexual intercourse with the dead in necrophilia are capable of haddi punishment, which, given the suspicion that arises due to the characteristics of the disorder, caution requires that haddi be waived from them and they be subject to ta’zir. Finally, it was recommended that a special commission be formed in judicial centers to make decisions regarding paraphiliacs.
