The primary objective of this research is to analyze the various dimensions of female delinquency and examine the interplay between legislative approaches within legal systems and modern, critical criminological theories. This study seeks to address fundamental questions: What role do structural and social factors play in the emergence of female delinquency? How do legal systems balance the principle of equality in criminal liability with the necessity of incorporating gender-specific considerations during judicial proceedings and the enforcement of sentences? And what is the rationale for transitioning from a punitive model to a rehabilitative one in the criminal management of women? Employing a descriptive-analytical method and focusing on a review of library resources and specialized texts in criminal law and criminology, this research investigates the challenges inherent in criminal policies. The findings indicate that female delinquency is a multifactorial phenomenon stemming from the intersection of economic and cultural factors and the trauma resulting from domestic violence. Furthermore, the results suggest that traditional approaches—which emphasized formal equality between men and women—have often failed to recognize specific needs and gender-based vulnerabilities. The study concludes that effective criminal management regarding women requires a shift from a purely punishment-oriented paradigm toward a paradigm of restorative and reformative justice; this entails upholding the principle of equality in liability while simultaneously utilizing differentiated mechanisms, alternative sanctions, and social support measures during the enforcement stage to facilitate the social reintegration of women and reduce recidivism rates.
